Terms and conditions of sale

These terms and conditions of sale govern all sales concluded on the site phonetronics.fr between Phonetronics SAS and any customer acting as a consumer. Any order implies full acceptance of these terms.

Phonetronics reserves the right to amend its terms at any time; the applicable terms are those in force on the date of the order.

The products offered are new phones, used devices and accessories. The essential characteristics of each product (capacity, colour, condition, grade where applicable) are stated on the product page.

Used devices are second-hand products restored to working order; their condition is indicated by a grade (A, B or C) defined in Article 10.

Prices are shown in euros, net of tax. Phonetronics operates under the French VAT-exempt small-business scheme (article 293 B of the CGI): VAT is not applicable and is therefore not charged. Prices do not include shipping costs, which are stated before order validation.

Phonetronics reserves the right to change its prices at any time; the product is invoiced at the price in force when the order is validated.

The customer selects the products, confirms the cart, enters delivery details and confirms the order after checking its details. Validation of the order constitutes acceptance of these terms.

The sales contract is concluded after payment confirmation. A confirmation email summarising the order is sent to the customer.

Payment is made online by bank card via our secure payment provider. Card details do not pass through our servers.

The order is only deemed effective after the payment centre has confirmed the transaction.

Offers are valid while stocks last. Stock is reserved when the order is validated. In the event of unavailability after the order, the customer is informed and refunded where applicable.

Products are delivered to the address indicated by the customer. Delivery times and costs are stated before order validation.

The risk of loss or damage is transferred to the customer when they, or a third party designated by them, take physical possession of the product.

The customer has a period of fourteen (14) days to exercise their right of withdrawal, under the conditions detailed on the "Right of withdrawal" page.

All products benefit from the legal warranty of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). Under the legal warranty of conformity, the consumer has a period of two (2) years from delivery of the goods.

The consumer may choose between repair and replacement of the goods, subject to the cost conditions provided for by law, and benefits from an exemption from proving the defect for twenty-four (24) months following delivery (twelve (12) months for second-hand goods).

Grade A: near-new appearance, possible micro-scratches not visible at 20 cm. Grade B: light visible signs of use. Grade C: marked signs of use, with no impact on operation.

Each used device is tested and benefits from a commercial warranty whose duration is stated on the product page, in addition to the legal warranties.

Any complaint may be addressed to after-sales service: sav@phonetronics.fr. In accordance with Article L.612-1 of the French Consumer Code, the customer may have free recourse to a consumer mediator for the amicable resolution of a dispute.

The customer may also use the European online dispute resolution (ODR) platform available at https://ec.europa.eu/consumers/odr.

Personal data collected in connection with orders is processed in accordance with the "Privacy policy".

These terms are governed by French law. Failing an amicable resolution, disputes fall under the jurisdiction of the French courts under ordinary law.
